Withdrawal of AFSPA



The withdrawal of AFSPA (Armed Forces Special Powers Act)1958 has now become a key issue to address in many states of India where AFSPA is present whether it is northeast states like Manipur, Arunanchal Pradesh or Jammu and Kashmir infact Irom sharmila who contested elections for Manipur state legislative assembly in 2017 did hunger strike for 16 years for the withdrawal of AFSPA from state calling it a draconian law but here we will talk on withdrawal of AFSPA from J&K state

In 1990 after militant uprising in J&K Governor of State Jagmohan imposed AFSPA in state and from last 27 years it is still there and just due to that Indian army, CRPF & J&K Police were alleged for Human rights violation in the states and many political parties in the state has made a clear agenda in there manifesto’s of  Withdrawal of AFSPA Including National Conference, People’s Democratic Party, Indian National Congress and Bhartiya Janta Party in 2015 when PDP-BJP alliance formed at that time they kept that agenda in there alliance some says if the AFSPA withdrawn then state will again notice a militant uprising like 1990 and it will not be in the favor of India nor Kashmir but every time some says that AFSPA an be withdrawn from those areas of JK state where no militant situation is Present that parts includes Jammu, leh, ladakh and some parts in Kashmir valley and it can be done because in Arunanchal Pradesh AFSPA is their but only in some areas not in full state and 2 years ago AFSPA was removed from the state of Tripura and recently Mehbooba Mufti, Chief Minister of J&K state said thatWe should not shy away from withdrawal of AFSPA. When things improve”  some says that it’s just a political statement because 2 bi elections are coming in state one is from Srinagar and other is from Anantnag from where her brother is contesting  so no one knows what’s in her mind. Before her Omar Abdullah also raised this issue many times when CM and after he left the office.
I believe that AFSPA should be withdrawn from the areas where no militancy is present that includes Jammu and Ladakh region and see what happens & if any situation arises so J&K police will take over it .

India needs such laws but there misuse should be stopped

Recently the supreme court of India has gave a judgement on sc/st act by saying that there be no automatic arrest on any complaint filed under the law and a preliminary inquiry must be conducted by police within seven days before taking any action.
