Today I want to quote Mr HKL Bhagat who was the
member of Indian National Congress he once said Buerocracy how so enlightened
cannot be a substitute for an elected government because elected representatives have there answer ability towards the Public which bureaucrats
doesn’t have and today the 5 judge bench of the supreme court which
Includes Chief Justice Dipak Mishra, Justice Atul Sikri, Justice Kharwekar,
Justice Chandrachur anmd Justice Ashok Bhushan has proven this quote right they said that the L-G cannot act as an
obstructionist and can refer issues to the President only in exceptional matters
and not as a general rule
The Puducherry Chief Minister V Narayanasamy has
welcome this decision by saying that "I welcome the verdict, and it is
totally applicable for the government of Puducherry which is also a Union
Territory,". Everyone is aware that he is engaged in a running feud with
Lt. Governor Kiran Bedi, Narayanasamy hailed the Supreme Court judgement on the
powers of an elected government, and insisted it was "totally
applicable" to the Union Territory too. The veteran Congress leader warned
he would file a contempt petition if the LG failed to act in accordance with
the apex court verdict.
There judgements were as follows
CJI Mishra on the behalf of Justice Atul Sikri,
Justice Kharwekar - The status of NCT Delhi is special a class apart and status
of Lieutenant Governor Delhi is not that of Governor but a Administrative head
in a limited sense and the LG is not Entrusted
with any Independent Power Decision Making and by quoting Article 239AA he said
that The LG has to either act on aid and advice of council of ministers or he
is bound to take decision made by the President and he also said that LG cannot
work as Obstructionist
Justice DY Chandrachur – Real power and
answer-ability is in the hands of the elected representatives and he also said
that LG must realise that the council of ministers are answerable to the people
and he cannot stall every decision of Delhi Government
The court has also made clear that is not mandatory
for the CM to take every permission from the Governor and it is 100% clear that
LG has only 3 departments in his hands one is land second is police and third
is Public Order and rest all are hands of Delhi Government
Full Statehood to Delhi
From 1956 to 1992 Delhi was a Union Territory and it
was run by the Chief Administrators and Lieutenant and after that in 1992 they
granted NCT status and Madan Lal Khuarana Became an elected CM of the State and
from them in each and every party said In their election manifesto that they
will give full state hood to delhi which no one did not even the Ruling AAP Party
but in the year 2002 LK Advani who was Minister of Home Affair made a proposal
in the Parliament that the area of Delhi which is Under NDMC should be kept
away from Delhi and rest of the Area should be declared as a full state but
that proposal didn’t got cleared and S
today has also not gave any judgement on that but one thing is clear
that delhi cannot be become a full state so BJP, Congress and AAP should not
Include this agenda in their manifesto’s and make false promises in front of public.
My
Opinion
This Judgement is a lesson not only for LG or BJP
but also for the Delhi Government and CM Mr. Arvind Kejriwal the lesson for the
BJP and LG is that you should not misuse your power for your selfish benefits and
you should remember the lesson of Uttrakhand and Arunanchal and for Mr Kejriwal
the biggest quality of the Former Chief Ministers was that they made a peace
with the LG and Opposition leaders and ran the government of Delhi which you
haven’t done that due to you anger issues which is not right you are in the federal
system and as the CM you have to follow that and make your people happy don’t
always act like a warrior who is always ready to wage wars act like a diplomat
and I am as your admirer is saying you this
But the Big question is it a end of the war between
Central Government and NCT Government now on the CM Cannot say that his
government works are been disturbed by LG because from now on LG is no one so
you should do all those works which LG stopped by using his power the schemes
like Door to Door Rashan Delivery and Regular the Lectures should be done
quickly and also the salary hike of the MLA’s
I also hope that it is an end to this Tissle of
Power now the real work starts.
