Capital Punishment in India : Ban or Not

Capital Punishment should be kept or not this is a topic of debate in many universities and social service areas there is a section which is demanding the ban on capital Punishment In India well the people who are supporting this thing or Talking against In many cases like Terrorist activities, Murders (302) , Rape the capital Punishment Provision is their and In 1980 Honor Killings is also Included in it and many criminals like Ajmar Kasab, Nathuram Gosde, Naryan Apte, Yakub Memon etc.. got capital Punishment for their crimes  but some socialist and communist wings doesn’t want capital punishment in India and for that they have their own facts and wings who supports this have there own facts and some of the facts which are against and for Capital Punishment in India are given below
1.       Dr B R Ambedkar who was the 1st Minister of Law and Justice, Central Government was against of capital Punishment
2.       In Bacchan singh v/s State of Punjab case of year 1980 Court has clearly said that in the rare of rarest cases the death penalty can be given
3.       In the Jyoti singh Rape case court has said that it is the rarest of rare case and all the criminals who were involved in it excluding one Juvenile got Death Penalty  
4.       In Shreemad Bhagwat Gita it is been said that the One human kills another human so he/she deserves only one punishment and that is death because murdering someone is a very heinous crime and can’t be spared and in other religious texts same thing is been said
5.       Some says that if Capital Punishment got cancelled then deadly practices in India Including Sati Pratha will get start because According to The Commission of Sati Prevention act 1987 says that if anyone forces any girl to Commit sati that man or women will be sentenced to Death
6.       But Many says that the Capital Punishment is totally Inhuman because sometimes a innocent got killed when court gives a wrong decision which happened many times.
In India the rate of Giving Capital Punishment is very low as compare to USA, UK, Arabic and Middle East countries which is nil in 2016, 1 in 2015 and nil in 2014 and so on and if u see the data of capital executions from 1995-2016 u will find the most number of executions are done in year 1995 which are 13 and 2nd is 1998 with 3 executions which shows that capital Punishment in India is somehow very less and those who are against capital punishment says that why don’t u keep life imprisonment to those who are committing heinous crimes but on the other hand people says that there is already a excess of prisoners in prisons which is also been said by the National Crime Records Bureau which is under Ministry of Home Affairs in Union Government
In Indian Constitution according to Government of India Act 1935 President of the Union have the power to provide clemency to that Individual who has received sentence to death  from the all courts and by using these powers many people got a relief from the death penalty

Now it is in the hands of Parliament and Assemblies to decide that what they want to do whether they want to trash this law or they want to maintain it In my opinion their should a Public census for the same and Supreme Court of India should do something so that situations gets clear.

India needs such laws but there misuse should be stopped

Recently the supreme court of India has gave a judgement on sc/st act by saying that there be no automatic arrest on any complaint filed under the law and a preliminary inquiry must be conducted by police within seven days before taking any action.
