Yesterday Court disqualified 20 MLA's of AAP in Office for Profit case in this 20 MLA's were appointed as Parliamentarian Secretary by the Delhi Government although the Notification clearly says that they will not get any salary and house for that but they can use government vehicle for Important Government work but last year a complaint happened there appointed was declared Void and now after this act Election Commission has send a recommendation to the Honourable President of India to suspend all these 20 MLA's but now the critics are asking question that in Haryana when 4 MLA's of BJP were found guilty then election commission then why doesn't they sent recommendation to sack these four as well why they are targeting only one party is there. well i don't know about that but whatsoever happening it is questionable when this case came up one more Office for Profit case happened in state of Madhya Pradesh just after 2 months on the complaint of AAP resident has summoned the Madhya Pradesh Government but there was no decision is taken just like in the case of Haryana although in history there are many examples where MP's and MLA's resigned in this case 2 cases were of 2 ladies Sonia Gandhi and Jaya Bacchan where both resigned voluntary. every one is waiting for the decision of Supreme court on the petition by 20 MLA's but still there are some news channels who are doing electoral surveys because they are saying that recommendation has gone to President and he is bound to approve recommendation by Election Commission but still they can wait because the decisions of the Honourable President can be challenged in the court as Uttrakhand court has said last year that President is not a king his decisions can be questioned. the office for profit case has also happened in many other states like West Bengal, TN, Kerela etc..
Today i was also reading an article by Mr. Ashutosh spokesperson of Aam Admi Party who called it a biased decision because the election commission did't called MLA's to give statement or a clarification on this matter and they gave judgement which was against the Nature of Law but EC is saying that they have called AAP Mla's for the but they didn't came so now who is true who is a lair let's see to it
Some years back a court in Kerala defined Office of Profit very clearly they said if any MP or MLA is getting monetary benefits then it is an office of profit but as AAP said that no salary was given this decision was good or not soon all the 20 MLA's will go to the supreme court to challenge this decision Let's see what happens next. hope democracy wins this is an appeal from a democrat.
